Terms of Service

1. Acceptance of Terms

By using Recess AI ("Service"), you agree to these Terms of Service and our Privacy Policy. If you are a parent or school administrator accepting on behalf of a child under 18, you represent that you have authority to do so. If you do not agree, please do not use the Service.

2. Children's Use — COPPA

Recess AI is intended for users of all ages, including children under 13. Children under 13 may only use the Service with verifiable parental consent, either obtained directly by us or through a school acting as an authorized agent. Parents may withdraw consent at any time by contacting us at privacy@recess.xyz. Upon withdrawal of consent for a child's account, we will delete that child's data within 30 days.

3. The Service

Recess AI provides AI-powered tutoring, emotional support, teacher tools, class management, and parent visibility features for K-12 education. The Service is provided "as is" with reasonable-efforts uptime. We may update, add, or remove features with reasonable notice.

Recess AI is an educational and supportive tool. It is not a substitute for professional mental health therapy or counseling. If a student is in crisis, please contact a qualified professional or emergency services.

4. Accounts and Eligibility

• You must provide accurate registration information
• You are responsible for maintaining the security of your credentials
• Each account is personal and non-transferable
• Schools creating accounts on behalf of students and parents are responsible for ensuring appropriate consent

5. Acceptable Use

You may not use Recess AI to:

• Violate any applicable law, including laws protecting children
• Harass, bully, or harm other users
• Attempt to circumvent safety filters or age restrictions
• Upload malware or attempt unauthorized access to the platform
• Use the Service to develop competing products

6. Subscriptions and Payment

Free accounts are available with limited features. Paid plans (Family and School) are billed monthly or annually as selected. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are not provided for partial periods except where required by law. Contact hello@recess.xyz for billing questions.

7. Intellectual Property

The Recess AI platform, branding, and software are owned by Lunchbox EdTech Inc. User-generated content (IEP documents, lesson plans, class rosters) remains owned by the user or school. We do not claim ownership of your content.

8. Limitation of Liability

To the maximum extent permitted by law, Recess AI is not liable for indirect, incidental, or consequential damages. Our total liability for any claim shall not exceed the fees paid by you in the 12 months prior to the claim. This limitation does not apply to liability arising from our gross negligence or willful misconduct.

9. Termination

You may cancel your account at any time from account settings. We may suspend or terminate accounts for material breach of these Terms. Parents may request deletion of a child's account and data at any time.

10. Governing Law

These Terms are governed by the laws of New York State. Disputes shall be resolved in courts located in New York County, NY.
