1. Who We Are

Recess AI is an AI-powered learning and emotional support platform for K-12 students, operated by Lunchbox EdTech Inc. ("Recess AI," "we," "us," or "our"). We are committed to the privacy and safety of children. Contact us at privacy@recess.xyz.

2. COPPA Compliance

Recess AI is designed for children under 13 and strictly complies with the Children's Online Privacy Protection Act (COPPA). We do not collect personal information from children under 13 without verifiable parental consent. Parents may review, correct, or request deletion of their child's information at any time by contacting privacy@recess.xyz.

If you are a school using Recess AI, the school acts as the authorized agent for obtaining COPPA consent on behalf of parents under the school consent exception.

3. What Data We Collect

• Students: Name, grade level, subject preferences, tutoring session content, emotional check-in responses, and IEP goals (if provided by parent or school). We collect the minimum necessary to provide personalized learning support.
• Parents: Name, email address, and relationship to the student. Payment information is handled by our payment processor and never stored on our servers.
• Teachers: Name, work email, school affiliation, and class/roster data they input into the platform.
• Website visitors: Aggregate analytics only (no personal identifiers, no ad tracking).

4. How We Use Data

• To deliver personalized AI tutoring and emotional support
• To generate progress reports for parents and teachers
• To improve the accuracy and safety of our AI models (using anonymized, aggregated data only)
• To send service communications (account updates, safety alerts)

We never sell student data. We never use student data for advertising. Ever.

5. AI and Emotional Support Data

Conversations between students and Recess AI's emotional support feature are private by default. Parents have visibility into emotional check-in summaries (mood trends, flagged concerns) but not verbatim conversation transcripts, to protect the student's sense of safety while ensuring parental oversight.

If our AI detects language indicating immediate risk to the student's safety, we will alert the parent or guardian and, if necessary, relevant emergency contacts. This is a safety feature, not surveillance.

6. Data Retention

Student data is retained for the duration of the active account plus 90 days. Parents may request deletion at any time, which will be completed within 30 days. Anonymized, aggregated model training data does not contain personal identifiers and is not subject to deletion.

7. Security

All data is encrypted in transit (TLS 1.2+) and at rest. Student emotional support conversations use end-to-end encryption. We conduct regular security audits and penetration testing. We will notify affected users within 72 hours of any confirmed data breach.

8. Parental Rights

Parents and guardians may at any time: review personal information collected about their child, correct inaccurate information, request deletion of their child's data, or withdraw consent for further collection. Contact us at privacy@recess.xyz. We will respond within 10 business days.

9. Changes to This Policy

We will notify parents and schools of any material changes to this Privacy Policy at least 30 days before they take effect. Continued use of Recess AI after changes take effect constitutes acceptance.
